1. Acceptance of Terms
These Terms & Conditions ("Terms") govern your use of the DrMobilePhone website and your purchase of any products from us. By browsing our website, creating an account, adding items to your cart, or completing a purchase, you confirm that you have read, understood, and agreed to these Terms in their entirety.
If you are purchasing on behalf of a business or organisation, you confirm that you have the authority to bind that entity to these Terms, and references to "you" shall include that entity.
These Terms do not affect your statutory rights as a consumer under Irish and EU law. Where any provision of these Terms conflicts with a mandatory statutory right, your statutory right shall prevail.
2. About Us
DrMobilePhone is an online retailer specialising in mobile phones and accessories, operating in accordance with Irish and European Union consumer protection law. Our business is registered and operates in the Republic of Ireland.
3. Account Registration
To make a purchase you are required to create an account. You agree to:

- ◆Maintain and promptly update your account information to keep it accurate and complete
- ◆Keep your password confidential and not share it with any third party
- ◆Be responsible for all activity that occurs under your account
- ◆Notify us immediately at our support address if you become aware of any unauthorised use of your account
You must be at least 16 years of age to create an account and purchase from DrMobilePhone. By registering, you confirm that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian before creating an account.
We reserve the right to suspend or terminate accounts that we reasonably believe have been used fraudulently, in breach of these Terms, or in a manner harmful to DrMobilePhone or other users.
4. Product Descriptions & Pricing
We take care to ensure that product listings on our website are accurate. However, we do not warrant that product descriptions, specifications, images, or other content are entirely error-free. Product photography is representative and actual appearance may vary slightly depending on your screen calibration.
All prices are displayed in Euro (€) inclusive of VAT at the applicable Irish rate. We reserve the right to change prices at any time without prior notice. The price applicable to your order is the price displayed at the time you place your order.
In the event of a pricing error on our website, we will notify you as soon as reasonably practicable and give you the option to either:
- ◆Proceed with your order at the correct price
- ◆Cancel your order and receive a full refund
We are not obliged to fulfil orders at incorrect (including significantly underpriced) listed prices. Promotional offers and sale prices apply for the stated period only and cannot be combined unless explicitly stated.
5. Orders & Payment
Order process: When you submit an order, you are making an offer to purchase goods at the stated price. Receipt of your order does not constitute acceptance. A contract is formed when we send you a payment confirmation email confirming that your order has been accepted and payment received.
We reserve the right to decline any order at our discretion, including (but not limited to) situations where:
- ◆A product is out of stock or discontinued after your order was placed
- ◆We are unable to verify your payment details
- ◆We suspect fraudulent or abusive activity on your account
- ◆There is a pricing or product description error on the listing
If we decline your order after payment has been taken, we will issue a full refund to your original payment method within 5 business days.
Payment:All payments are processed securely through Stripe, Inc. We accept major credit and debit cards. We do not store, process, or have access to your full card details at any point — these are handled entirely by Stripe and are subject to Stripe's own privacy and security policies. Payment is taken at the time of placing your order.
6. Shipping & Delivery
We offer a range of delivery options including standard delivery, express delivery, and in-store collection. Delivery timeframes are estimates and are not guaranteed. Actual delivery times may vary due to carrier delays, public holidays, adverse weather, or other circumstances beyond our control.
Risk and title: Risk of loss or damage to goods passes to you upon delivery to the address specified in your order. Title to goods passes to you upon receipt of cleared payment.
Failed delivery: If a delivery attempt is unsuccessful and the item is returned to us, we will contact you to arrange redelivery. Additional delivery charges may apply. If we are unable to contact you within a reasonable period, we reserve the right to cancel the order and issue a partial refund (excluding original delivery charges).
Damaged in transit: If your item arrives visibly damaged, please refuse the delivery or note the damage with the carrier and contact us immediately with photographs. We will arrange a replacement or refund.
7. Repair Services
In addition to our retail store, DrMobilePhone provides mobile device repair services. The following additional terms apply to repair services:
- ◆Repair estimates: Any estimate provided before work commences is indicative and non-binding until you have confirmed in writing that you wish to proceed. We will contact you if the actual cost is expected to exceed the estimate before undertaking additional work.
- ◆Device credentials: Where you provide a device PIN or password to enable diagnosis or repair, we store this securely and use it solely for the purpose of performing the repair. Credentials are deleted from our systems upon completion of the repair.
- ◆Data backup: We strongly advise you to back up all data on your device before submitting it for repair. DrMobilePhone accepts no liability for the loss of data during the repair process. You are responsible for backing up your data prior to submission.
- ◆Pre-existing damage: We are not liable for pre-existing damage, faults, or defects present on the device at the time of submission that are not related to the reported fault. We will note any visible pre-existing damage at intake.
- ◆Repair guarantee: Completed repairs carry a guarantee period (as stated on your repair receipt or confirmation email). If the same fault reoccurs within the guarantee period, we will re-examine and where appropriate redo the repair at no additional charge.
- ◆Uncollected devices: Devices not collected within 90 days of notification of completion may, after reasonable attempts to contact you, be subject to a storage charge or disposal in accordance with Irish law.
8. Returns & Refunds
We operate a 30-day returns policy, which exceeds the minimum 14-day statutory cooling-off period required under the EU Consumer Rights Directive (2011/83/EU) and the Irish Consumer Rights Act 2022.
To be eligible for a return, items must be in their original, unused condition with all packaging, accessories, and documentation included, and returned within 30 days of delivery.

9. Warranty & Faulty Goods
All products sold by DrMobilePhone carry the statutory 2-year guarantee under EU Directive 2019/771 on the sale of goods (implemented in Ireland via the Consumer Rights Act 2022). This guarantee covers material defects and non-conformity with the contract that existed at the time of delivery.
If a product becomes defective within the first 12 months, it is presumed that the fault existed at the time of delivery. You are entitled to:
- ◆A free repair or replacement as the first remedy
- ◆A price reduction or full refund if repair/replacement is not possible or not completed within a reasonable time
The statutory guarantee does not cover faults caused by accidental damage, misuse, liquid damage, unauthorised modification, or normal wear and tear. Warranty claims do not affect any separate manufacturer's warranty that may accompany your product.
10. Intellectual Property
All content on this website — including but not limited to text, product descriptions, photographs, graphics, logos, trade marks, icons, and software — is the property of DrMobilePhone or its content suppliers and is protected by Irish and EU intellectual property law, including copyright, trade mark, and database rights.
You are permitted to access and use the website for personal, non-commercial purposes only. You may not:
- ◆Copy, reproduce, republish, download, post, or transmit any content without our prior written consent
- ◆Use any content for commercial purposes or public display
- ◆Attempt to decompile or reverse-engineer any software on the website
- ◆Remove any copyright, trade mark, or proprietary notices from materials
Third-party trade marks (such as phone manufacturer brand names referenced in product descriptions) remain the property of their respective owners and are used for identification purposes only. No endorsement or affiliation is implied.
11. User Conduct
When using our website, you agree not to engage in any of the following prohibited activities:
- ◆Using the website for any unlawful purpose or in violation of any applicable law or regulation
- ◆Submitting false, misleading, or fraudulent orders, returns, or account information
- ◆Impersonating any person or entity, or falsely claiming an affiliation with a person or entity
- ◆Attempting to gain unauthorised access to any part of our website, our servers, or any system or network connected to our website
- ◆Engaging in automated scraping, data harvesting, or systematic downloading of content without our prior written consent
- ◆Introducing viruses, trojans, worms, or other malicious or technologically harmful material to our website
- ◆Using our platform to send unsolicited commercial communications (spam)
- ◆Engaging in any conduct that is abusive, threatening, or harassing toward our staff or other users
- ◆Attempting to circumvent or disable any security or access-control features of the website
- ◆Reselling products purchased from us without our prior written consent, where such resale would breach manufacturer terms or applicable law
We reserve the right to suspend or permanently terminate access to our website and services for any user who breaches these conduct requirements, without prejudice to any other remedies available to us.
12. Limitation of Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other matter for which it would be unlawful to exclude or limit liability under Irish law.
Subject to the above, to the fullest extent permitted by applicable Irish and EU law, DrMobilePhone's total liability to you (whether in contract, tort including negligence, or otherwise) in connection with any order shall not exceed the total amount paid by you for that order.
We are not liable for:
- ◆Indirect, special, incidental, or consequential losses or damages
- ◆Loss of profits, business, revenue, goodwill, or anticipated savings
- ◆Loss of data or damage to computer systems arising from use of our website
- ◆Interruption or unavailability of the website, including for maintenance
- ◆Delays or failures caused by circumstances beyond our reasonable control (force majeure)
We do not guarantee that our website will be uninterrupted, error-free, or free from viruses or other harmful components. You are responsible for implementing appropriate security measures on your own devices.
13. Data Protection
DrMobilePhone is the data controller responsible for personal data collected through this website. We process your personal data in accordance with the EU General Data Protection Regulation (GDPR) and the Irish Data Protection Acts 1988–2018.
By placing an order, creating an account, or submitting a device for repair, you acknowledge that we will collect and process certain personal data as necessary to fulfil our contractual obligations to you, including processing your order, managing your account, providing repair services, and communicating with you about your purchases.

14. Governing Law & Disputes
These Terms & Conditions and any disputes or claims arising out of or in connection with them (including non-contractual disputes) are governed by and construed in accordance with the laws of the Republic of Ireland.
Both parties agree to submit to the exclusive jurisdiction of the courts of the Republic of Ireland to resolve any legal disputes. However, nothing in this clause prevents you from relying on mandatory consumer protection laws in your country of residence if more favourable to you.
Online Dispute Resolution (ODR): As an EU-based business, we are required to inform you that the European Commission provides an Online Dispute Resolution platform for resolving disputes between consumers and traders, available at ec.europa.eu/consumers/odr. 15. Severability
If any provision of these Terms & Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable to any extent, that provision will, to that extent only, be severed from the remaining terms and conditions, which will continue to be valid and enforceable to the fullest extent permitted by law.
16. Changes to These Terms
We reserve the right to amend these Terms & Conditions at any time. Changes will be posted on this page with an updated revision date. For material changes, we will endeavour to provide reasonable notice via email or a prominent notice on our website.
Your continued use of our website or placement of an order after any changes constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically. If you do not accept any change, you should stop using our website and not place further orders.
